Scope of these Terms and Conditions

These Terms and Conditions ("Terms", "Agreement") govern the use of all mobile applications ("Applications") developed and operated by Symbiot Development OU ("the Company", "We", "Us", or "Our"), a company registered at Kaupmehe tn 7 - 120, Tallinn, Kesklinna linnaosa, Harju maakond, 10114, Estonia. The Applications covered by these Terms include:

• Spanday PRO
• DanceHub

As Symbiot Development OU introduces new Applications, these Terms will apply to their use unless otherwise specified. Updates to the list of covered Applications will be reflected in this document, accessible at Terms & Conditions.

By accessing or using any of the Applications, You agree to be bound by these Terms. If You disagree with any part of the Terms, You may not access or use the Applications.

Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or plural.

Definitions

For the purposes of these Terms and Conditions:

• Account means a unique account created for You to access our Service or parts of our Service.
• Affiliate means an entity that controls, is controlled by, or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest, or other securities entitled to vote for election of directors or other managing authority.

• Applications refer to all mobile applications developed and operated by Symbiot Development OU, including but not limited to:

  • DanceHub

    As Symbiot Development OU introduces new applications, they will be governed by these Terms and Conditions unless otherwise specified. Updates to the list of covered applications are reflected in the "Scope of these Terms and Conditions" section, accessible at Terms & Conditions.

• Company (referred to as either "the Company", "We", "Us", or "Our" in this Agreement) refers to Symbiot Development OU, Kaupmehe tn 7 - 120, Tallinn, Kesklinna linnaosa, Harju maakond, 10114, Estonia.

• Country refers to: Estonia.
• Device means any device that can access the Service, such as a computer, a cellphone, or a digital tablet.
• Service refers to the Application.
• You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Acknowledgment

These Terms and Conditions govern the use of the Service and constitute an agreement between You and the Company. These Terms set out the rights and obligations of all users regarding the use of the Service. Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

Accounts

To access certain features of the Service, You may be required to create an Account. When You create an Account, You agree to:

• Provide accurate, current, and complete information during the registration process.
• Maintain the security of Your password and accept all risks of unauthorized access to Your Account.
• Notify Us immediately if You discover or suspect any security breaches related to Your Account.
• Be solely responsible for all activities that occur under Your Account.

We reserve the right to refuse service, terminate Accounts, or remove or edit content at Our sole discretion.

Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates any applicable local, national, or international law or regulation.
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by Us, may harm the Company or users of the Service.
• Use the Service to transmit, or procure the sending of, any advertising or promotional material without Our prior written consent.
• Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service.

Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Symbiot Development OU and its licensors. The Service is protected by copyright, trademark, and other laws of Estonia and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Symbiot Development OU.

User Content

The Service may allow You to submit, upload, or share content, such as pictures or other information from Your Device’s camera and photo library ("User Content"). By submitting User Content, You grant Us a non-exclusive, royalty-free, worldwide, perpetual license to use, store, reproduce, modify, and distribute such User Content for the purpose of operating, promoting, and improving the Service.

You represent and warrant that:

• You own or have the necessary rights to submit the User Content.
• The User Content does not violate any applicable laws or the rights of any third party.

We reserve the right to remove or disable access to any User Content that violates these Terms or is otherwise objectionable, at Our sole discretion.

Third-Party Links and Services

The Service may contain links to third-party websites or services that are not owned or controlled by Symbiot Development OU. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

Additionally, our Service may integrate third-party tools and APIs to enhance functionality. For example, we use ipapi.co to determine users’ approximate location based on their IP address in order to improve localization and user experience. These third-party services are governed by their own terms and policies.

You acknowledge and agree that Symbiot Development OU shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

Termination

We may terminate or suspend Your Account and access to the Service immediately, without prior notice or liability, for any reason, including if You breach these Terms. Upon termination, Your right to use the Service will cease immediately. If You wish to terminate Your Account, You may do so by discontinuing Your use of the Service or contacting Us at info@symbiot.dev.

Subscriptions and Billing

Our app offers access to features and services through four auto-renewable monthly subscription plans: Starter, Team, Advanced, and Unlimited. All subscriptions are processed and billed through the App Store (Apple) or Google Play (Android), depending on your device.

1. Billing and Auto-Renewal

Payment will be charged to your Apple or Google account at confirmation of purchase. Subscriptions automatically renew every month unless auto-renew is turned off at least 24 hours before the end of the current billing period.

The renewal will be charged to your account within 24 hours before the end of the current period, at the same price and duration unless otherwise specified.

2. Managing Your Subscription

You can manage or cancel your subscription in your device account settings at any time:

For iOS: Manage via Apple

For Android: Manage via Google Play

Deleting the app does not cancel your subscription. You must cancel it manually to avoid further charges.

3. Trial and Refunds

We do not offer free trials at this time. All payments are final. Refunds are managed exclusively by Apple and Google in accordance with their respective policies.

4. Changes to Pricing or Plans

We reserve the right to change subscription prices or features with prior notice. Any price changes will be communicated clearly and will require user consent before taking effect.

Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Symbiot Development OU, its Affiliates, directors, employees, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service.
• Any conduct or content of any third party on the Service.
• Any content obtained from the Service.
• Unauthorized access, use, or alteration of Your transmissions or content.

Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Symbiot Development OU makes no warranties, expressed or implied, regarding the Service, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Estonia, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Tallinn, Estonia.

Changes to These Terms

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material, We will provide notice by posting the updated Terms on this page and updating the "Last updated" date at the top of these Terms. You are advised to review these Terms periodically for any changes. Changes to these Terms are effective when they are posted on this page.
